What Is Legal Separation in Maryland?
Separation is more complicated than one spouse deciding to move out and it carries legal consequences.
In order for a separation to be considered legitimate, it must happen under at least one of two circumstances. Regardless of why the separation occurs, it must be agreed upon by both spouses. Separation as a result of infidelity, substance abuse, violence, etc. may also provide grounds for legal separation in the state of Maryland. Currently, no minimum residency requirement exists in order to obtain a decree of separate maintenance.
Challenges You May Encounter During Separation
When two spouses agree to live and operate separately, there may be challenges, especially when it comes to money and parenting. We may be able to assist you in resolving disagreements that pertain to the following:
- Custody and visitation of children under 18
- Child support
- Healthcare for minor children
- Maintenance of marital property and assets
- Mutual debts and financial obligations
- Spousal support
If applicable, we may also be able to help you take measures to protect yourself if you and your spouse are separating due to violence, abuse, or any other threat to your wellbeing or that of your children. In such cases, we can help you obtain a restraining order, if necessary.
