Are My Facebook Records Relevant in My Custody Case? | Friendship Heights Attorney

Transcript

Your Facebook profile contains a lot of information about you. It includes records of who you associate with, what you say to them, what they say to you, and pictures of you with these individuals or others you may be friends with.

In custody and visitation cases, this information is usually discoverable. It can be valuable evidence for the court to consider when determining if you are a fit and proper parent.

The standard for discovery is whether the information is “reasonably calculated to lead to admissible evidence.” Therefore, even if there isn’t direct evidence in your profile that can be used against you, it doesn’t mean they won’t be able to look through it and find something relevant.
