In Virginia, there is no such thing as a legal separation. However, there are statutory waiting periods you must meet in order to obtain a no-fault divorce. For example, the waiting period is six months if there are no children involved and you have a signed agreement, or 12 months if there are children involved or you are unable to reach an agreement.

During this time, you are separated, and one party must have the intent to divorce. However, there is no formal recognition of this separation period until you actually obtain the divorce—it is just part of the process to prove your eligibility for divorce.
