Virginia Divorce Laws
Each state has its own laws regarding divorce. In Virginia, you can obtain a divorce based on either fault or no-fault grounds. - Child support: Child support is financial support that is paid from one parent to the other after a divorce. The amount of child support that is paid is based on the Virginia Child Support Guidelines.
If you and your spouse do not have a signed separation agreement, you can still obtain a no-fault divorce in Virginia. However, you will need to live apart for at least one year before you can file for divorce.
If you wish to obtain a fault-based divorce in Virginia, you can do so on the following grounds:
- Adultery
- Cruelty
- Desertion
- Conviction of a felony
- Insanity
You must be able to provide proof of these grounds in order to obtain a fault-based divorce in Virginia. This can make fault-based divorce more difficult and costly than no-fault divorce.
