Custody and Visitation

In Virginia, custody and visitation is determined by the “best interests of the child” standard. The best interests of the child standard allows a judge to hear evidence from both parents to determine which custody arrangement is best of for the child(ren).

There is no presumption that one parent is more fit than another. Instead, the court will examine a myriad of statutory factors when determining how each parent will serve the best interests of the child. Some factors considered are the age of the child, needs of the child, relationship of each parent with the child, history of family abuse, and any other factor that the court “deems necessary and proper”.
