Prenuptial agreements can provide for the disposition of assets and the payment of spousal support in the unfortunate event of a divorce. Spousal support provisions are typically enforceable in these agreements, provided that the rest of the agreement is sound.
If you decide to waive your rights to spousal support or limit how much spousal support you will receive, it is usually enforceable when the agreement is put into play. However, there are some cases where the agreement might not hold up, or the waiver or other provisions could be deemed unconscionable or subject to a contract defense.
All else being equal, these waivers are usually enforceable.
